A creator featured by Being Gurkha may be an affiliate, influencer, independent contractor, collaborator, community contributor or other promotional partner. Inclusion in the Influencer Hub identifies a relationship or collaboration at the time of publication; it does not necessarily mean employment, agency, partnership, ownership or authority to bind Being Gurkha. The precise relationship is governed by any applicable written agreement.

Unless explicitly authorised in writing, a creator’s personal views, statements, posts, political opinions, associations, off-duty conduct and independent commercial activities are their own. They must not be presented as official statements or policies of Being Gurkha. Displaying a creator’s profile does not mean that Being Gurkha approves, adopts or endorses every action, belief or statement of that person.

Being Gurkha expects collaborators to act honestly, respectfully and lawfully; avoid harassment, threats, discrimination, exploitation, hate speech, violence, deceptive activity and conduct that places others at risk; and respect the dignity of the community. Allegations are assessed with appropriate care, and no adverse conclusion should be inferred merely because a concern has been raised.

Creators must make commercial relationships clear, obvious and upfront wherever required. Sponsored posts, affiliate links, referral codes, gifted products, commissions and other incentives must be disclosed in a way the intended audience can understand. A profile listing or this disclaimer is not a substitute for disclosure on the actual promotional content. Being Gurkha and creators remain responsible for their respective legal obligations.

Promotional claims must be truthful, supportable and consistent with a creator’s genuine experience. Creators must not invent testimonials, exaggerate product performance, imply unsupported certifications, promise results, or misrepresent pricing, delivery, discounts or product availability. Content may require review, correction or removal where inaccurate or misleading.

Creator codes, links, offers and commissions may be subject to eligibility rules, expiry dates, exclusions and separate terms. Publication of a code does not guarantee ongoing availability or an unrestricted discount. Being Gurkha may modify or discontinue offers subject to applicable terms, law and any contractual obligations. Codes do not authorise creators to make commitments on the brand’s behalf.

Qualifications, sporting records, awards and other credentials displayed on creator profiles are supplied or represented by the relevant creator or appropriate sources. Where practical, Being Gurkha may seek verification, but a listing should not be interpreted as a professional licence, warranty of skill or endorsement of independent services. Please verify qualifications directly with their issuing bodies where relevant.

Links to creator social profiles and other third-party destinations are provided for convenience. Those platforms and accounts are not controlled by Being Gurkha, and their availability, security, terms and content may change. Visitors should review third-party terms and exercise their own judgement. Being Gurkha does not adopt third-party content merely by linking to it.

Creators may use Being Gurkha trademarks, artwork, imagery, logos and campaign materials only as authorised by the brand and subject to applicable agreements and law. They must not falsely imply official approval, alter protected materials beyond their permitted use, or licence brand assets to others. Being Gurkha may request correction or removal of unauthorised brand representations.

Concerns about creator conduct, advertising, misleading claims, safety or misuse of Being Gurkha branding may be submitted through the official contact channel below. Please include relevant links, dates and context where possible. Being Gurkha may investigate, seek further information, refer serious matters to appropriate authorities, or take other proportionate steps. The brand does not promise to disclose confidential investigative details or a particular outcome.

Where credible issues arise or brand standards are not met, Being Gurkha may review or suspend promotional activity, remove a profile, withdraw authorisation to use brand assets, pause codes, or terminate a relationship where permitted by applicable agreements and law. Such action does not necessarily constitute a finding of wrongdoing. Any decisions remain subject to legal and contractual obligations.

This notice describes the distinction between the brand and independent creators. It does not waive consumer guarantees or other rights under Australian Consumer Law, excuse misleading advertising, release Being Gurkha from responsibility for its own acts or omissions, or exclude any liability that cannot lawfully be excluded. If there is an inconsistency with mandatory law, that law prevails.

Only communications published through authorised Being Gurkha channels or made by expressly authorised representatives should be treated as official brand positions. This notice may be reviewed and updated as programs, creator arrangements, laws and practices change. Material changes should be reflected on this page with a current effective date.
